These Terms and Conditions (“Terms”) govern your access to and use of the ByStander mobile application, website, and related services (collectively, the “App” or “Services”). By accessing or using ByStander, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the App.
1. Description of Services
ByStander is a personal safety assistance platform designed to provide awareness, documentation, and access to human advocates during uncertain situations. The App may include features such as live video streaming, location sharing, evidence capture, wellness checks, educational content, and optional health signal monitoring.
ByStander is not:
- An emergency response service
- A replacement for 911 or local emergency services
- A medical device
- A provider of medical, mental health, legal, or professional advice
2. No Emergency or Professional Services
ByStander does not provide emergency response, law enforcement, medical treatment, mental health counseling, or legal advice.
If you are in immediate danger, experiencing a medical emergency, or facing a mental health crisis, contact local emergency services immediately.
Use of the App does not guarantee safety, prevention of harm, or successful outcomes.
3. Performance and Device Limitations
You acknowledge and agree that the performance and functionality of ByStander are subject to the limitations of your device, including but not limited to:
- Hardware capabilities
- Operating system version
- Battery life
- Network connectivity (cellular, Wi-Fi, GPS)
- Sensor accuracy
- Device permissions and user settings
- Background process restrictions
- Storage availability
ByStander does not guarantee uninterrupted service, real-time accuracy, or successful feature operation in all conditions. Performance may be degraded or unavailable due to factors outside our control.
4. Best-Effort Services
All ByStander features operate on a best-effort basis. This includes, but is not limited to:
- Live streaming
- Notifications
- Location sharing
- Evidence capture
- Advocate availability
- Health signal monitoring
You acknowledge that:
- Technical failures may occur
- Human advocates may not always be available
- Data may be delayed, incomplete, or unavailable
- No feature guarantees a specific result
5. Use of Artificial Intelligence (AI)
Certain features may utilize artificial intelligence (AI) or automated systems to provide informational content, pattern recognition, or support features.
AI outputs:
- Are informational only
- May be inaccurate, incomplete, or outdated
- Do not replace professional judgment or care
- Should not be relied upon as advice or instruction
6. Health Monitoring Disclaimer (LifeSupport)
LifeSupport features:
- Are not medical devices
- Do not provide diagnosis, treatment, or medical advice
- Rely on third-party smartwatch data
- Are limited by device accuracy and user configuration
Health-related features are for awareness only and must not be used as a substitute for professional medical care.
7. Advocates and Third Parties
Advocates:
- Are independent contractors
- Are not employees, agents, or representatives of ByStander
- Are not emergency responders
- Are not authorized to provide medical, legal, or mental health advice
ByStander does not control or guarantee advocate actions, availability, or outcomes.
8. User Responsibilities
You agree to:
- Use the App lawfully and responsibly
- Not misuse or abuse safety features
- Provide accurate information
- Maintain confidentiality of your PIN and account
- Understand that misuse may result in suspension or fees
You are solely responsible for how you interpret and apply information from the App.
9. Evidence and Data
Evidence captured through the App:
- Is stored subject to device and system limitations
- May be synced to third-party cloud services at your discretion
- Is your responsibility to manage, review, and retain
ByStander does not guarantee long-term storage or data preservation.
10. Fees, Subscriptions, and Payments
ByStander may offer paid subscriptions, preorders, or optional tipping features.
All payments:
- Are processed by third-party payment providers
- Are subject to their terms
- Are non-refundable unless required by law or explicitly stated
11. Misuse and Enforcement
ByStander reserves the right to:
- Monitor for misuse or false alerts
- Issue warnings
- Apply usage restrictions
- Charge fees for repeated misuse
- Suspend or terminate accounts
12. Limitation of Liability
To the maximum extent permitted by law, ByStander, its owners, developers, affiliates, contractors, advocates, and service providers shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from:
- Use or inability to use the App
- Device limitations or failures
- Network issues
- Reliance on App content or AI outputs
- Advocate actions or inactions
- Personal injury, emotional distress, or financial loss
13. No Warranties
The App is provided “as is” and “as available” without warranties of any kind, express or implied.
ByStander disclaims all warranties, including fitness for a particular purpose, accuracy, reliability, or availability.
14. Indemnification
You agree to indemnify and hold harmless ByStander and its affiliates from any claims, damages, or losses arising from:
- Your use of the App
- Violation of these Terms
- Misuse of features
- Violation of laws or rights of others
15. Termination
ByStander may suspend or terminate your access at any time for violation of these Terms or misuse of the App.
You may stop using the App at any time.
16. Changes to Terms
We may update these Terms periodically. Continued use of the App after changes constitutes acceptance of the updated Terms.
17. Governing Law
These Terms are governed by the laws of Illinois, without regard to conflict of law principles.
